John J. Manier
is a graduate of the University of Notre Dame (B.A. 1986) and UCLA
School of Law (J.D. 1989), where he served as an Editor of the UCLA
Law Review and received the American Jurisprudence Awards for Excellence
in Property and Constitutional Law. Throughout his career, Mr. Manier
has practiced extensively in employment-related litigation at the
trial and appellate levels. He has appeared and argued before the
California Supreme Court, the California Court of Appeal and other
state and federal courts. Mr. Manier also has been one of the firm's
counsel of record in several published decisions where our clients
obtained favorable results. These include Venetian Casino Resort,
LLC v. EEOC, 409 F.3d 359 (2005) [employer's challenge to EEOC
policies for disclosing confidential commercial information was
ripe]; Reeves v. Hanlon, 33 Cal.4th 1140 (2004) [employer
may sue competitor for tortious interference with at-will employment
contracts between employer and its employees]; Turner v. Anheuser-Busch,
Inc., 7 Cal.4th 1238 (1994) [establishing standards for constructive
wrongful discharge cases in California]; GAB Business Services,
Inc. v. Lindsey & Newsom Claim Services, Inc., 83 Cal.App.4th
409 (2000) [corporate officer owed fiduciary duty of loyalty as
a matter of law]; Saret-Cook v. Gilbert, Kelly, Crowley & Jennett,
74 Cal.App.4th 1211 (1999) [affirming $650,000 attorney fee award
for an employer who obtained a defense judgment in a sex harassment
and discrimination lawsuit]; Bardin v. Lockheed Aeronautical
Systems Co., 70 Cal.App.4th 494 (1999) [company's communications
to Los Angeles Police Department during background check on former
company employee were absolutely privileged from tort liability];
and Kirmse v. Nikko Hotel San Francisco, 51 Cal.App.4th 311
(1996) [affirming summary judgment for employer on job bias and
related claims, even though claims were not barred by treaty between
United States and Japan].
Prior to joining the firm, Mr. Manier served as a Law Clerk to the
late Irving Hill, Senior United States District Judge, Central District
of California. Mr. Manier is the author of "The Attorney-Client
Privilege and its Availability to Insured Persons," which was
published at 36 UCLA L. Rev. 977 (1989), and assisted in the drafting
of a chapter of the treatise "Sexual Harassment in Employment Law"
(1992). Mr. Manier also has written or co-written several articles
on labor and employment law issues in the LOS ANGELES DAILY JOURNAL,
and he serves as an editor of the Firm's Management Memo. Mr. Manier
is admitted to practice before the United States Supreme Court,
the United States Courts of Appeals for the D.C., Third, Ninth and
Tenth Circuits, and all federal and state courts in California.
He is an active member of the California bar and the Labor and Employment
Section of the Los Angeles County Bar Association.
