Richard S. Rosenberg

Ballard Rosenberg Golper & Savitt, LLP is an A-V rated law firm of twenty-five attorneys engaged exclusively in the practice of all aspects of labor and employment law on behalf of management. RICHARD S. ROSENBERG is a founding partner of the firm. He is a graduate of the College of Industrial and Labor Relations at Cornell University and the University of Santa Clara Law School. Mr. Rosenberg has spent his entire career (30+ years) providing advice and counsel to management (exclusively) on the entire spectrum of labor relations and employment law matters.

Mr. Rosenberg was recognized as a Southern California Super Lawyer by Los Angeles Magazine and the Journal of Law and Politics for 2007. Mr. Rosenberg has received this recognition each year since the award was created in 2004. In addition, Mr. Rosenberg was named among the Best Lawyers in America by that publication. In 2007, Mr. Rosenberg was named by the San Fernando Valley Business Journal as one of the top 25 attorneys in the San Fernando Valley.

Mr. Rosenberg’s work includes advice on employment law strategy and compliance, as well as litigation, covering such diverse areas as wage-hour collective and class actions, traditional labor relations matters (union organizing, strikes/picketing, collective bargaining, grievance handling and arbitration and the acquisition/divesture of unionized businesses), class actions and individual claims for employment discrimination, sexual and other workplace harassment, wrongful termination, whistleblower complaints, occupational safety and health, trade secret protection/enforcement, WARN Act compliance, immigration law compliance, FMLA, ADA, COBRA, HIPAA, and Sarbanes-Oxley whistleblower matters.

Mr. Rosenberg is a recognized expert in wage-hour law. He and partners Stephen Lueke and Matt Wakefield have written a leading treatise on wage-hour law for California lawyers as part of Advising California Employers (published by the California Continuing Education of the Bar). Mr. Rosenberg also co-authored the firm’s Family Medical Leave Act Manual and writes the firm’s twice monthly Management Memo which is e-mailed to 3500 recipients.

Mr. Rosenberg also assists clients develop management oriented employment agreements, personnel policies, trade secret and proprietary information agreements, codes of ethical conduct, non-compete agreements, sexual and other workplace harassment policies, and routine employment forms (e.g., employment application, formal evaluation, employee handbook, FMLA compliance forms).

Mr. Rosenberg regularly appears before federal and state courts and administrative agencies such as the NLRB, EEOC and the California DFEH, the Cal/OSHA Appeals Board, United States Department of Labor, the California Division of Labor Standards Enforcement, California Employment Development Department, and the United States Bureau of Citizenship and Immigration Services (formerly Immigration and Naturalization Service).

As part of the Firm’s preventive practice, Mr. Rosenberg designs and presents customized internal management training programs on a broad range of employment law matters such as sex harassment, in-house investigations of theft, sexual harassment and other workplace misconduct, wrongful termination, wage-hour law compliance, compliance with federal and state laws covering family/medical leave, disability discrimination (ADA and state law) and the development of legally compliant employer policies. Mr. Rosenberg has trained well over 15,000 business executives and managers on labor/employment compliance matters.

Mr. Rosenberg is a sought after public speaker. Mr. Rosenberg has been the featured speaker for the Continuing Education of the Bar and the Employment Law Section of the Los Angeles County Bar Association and the Association of Southern California Defense Council. For the past 27 years, Mr. Rosenberg has done lectures throughout California sponsored jointly by the California Employment Development Department and the California Employer Advisory Council. Mr. Rosenberg presents annual programs in Southern California for Lorman Education Seminars on wage-hour law, effective hiring practices and FMLA compliance. Mr. Rosenberg has also been a featured speaker the past three years at the annual employment law program of the California CPA Society.

Mr. Rosenberg is widely recognized in the legal community for his expertise in employment law. He serves as a regular contributing author in the Los Angeles Daily Journal legal newspaper and wrote a regular column on labor law compliance for several years. Mr. Rosenberg has recently published several articles on employment law in the San Fernando Valley Business Journal and is scheduled to author a recurring column on labor/employment law for that publication.

Mr. Rosenberg also is especially adept in resolving disputes through the creative use of Alternative Dispute Resolution, having represented many clients in mediation and other ADR procedures. Mr. Rosenberg brings a unique perspective to these matters because he is a trained mediator and serves as a neutral. Mr. Rosenberg holds certificates in mediation training from Dispute Resolution Services (Los Angeles County Bar Association), and Pepperdine University’s internationally recognized Strauss Institute for Dispute Resolution. Mr. Rosenberg has served as a court appointed mediator through the Los Angeles and Ventura County Superior Courts’ mediation programs.
