Trial Court Properly Certified Overtime Class Action on Behalf of Sav-On Managers.

The California Supreme Court has ruled that a trial court properly certified an overtime class action on behalf of assistant managers and operating managers who allegedly were misclassified as exempt employees by the Sav-On drug store chain. The case arose out of allegations that Sav-On misclassified the employees to avoid paying overtime pay. The Court’s ruling in the case will likely encourage the filing of similar cases because of its very favorable (to employees) language on the use of class action claims for alleged wage violations.

Standardized Workers’ Compensation Release Does Not Operate to Bar Civil Claims by Employees Unless Subject to a Separate Release.

The California Supreme Court has held that a standardized Compromise & Release Form used to resolve claims before the Workers’ Compensation Appeals Board does not operate to release causes of actions that are not within the scope of workers’ compensation law unless there is a separate document specifically releasing such claims.
