Employer Must
Make Reasonable Efforts To Accommodate Employee's Religious Beliefs The Court of Appeal has held that an employer engaged in illegal religious discrimination when the employer flatly refused to permit an employee to attend a Jehova's Witness convention. The Court held that the employer has an affirmative duty to endeavor to accommodate the religious beliefs of the employee and its failure to do so was not in keeping with the State's job bias law. Corporate Reorganization That Negatively Impacted Female Administrative Managers Over 40 Was Not Discriminatory Evidence of an employer's corporate reorganization that disparately impacted administrative managers over 40, most of whom were female, did not establish gender or age discrimination. At most, the evidence established a disparate impact on administrative managers, not a protected group such as women over 40. [ back to top ] |
