State Agency Lacks Discretion to Withdraw Employer Penalty for Failure to Obtain Workers' Compensation Insurance. The California Court of Appeal has held that the California Department of Industrial Relations, Division of Labor Standards Enforcement cannot withdraw penalties imposed against an employer for failure to obtain Worker's Compensation insurance. Employer Required to Provide Employee with Copies of Public Records Uncovered in an Investigation of the Employee The California Court of Appeal has held that when an employer conducts an investigation based upon on suspicion of employee wrongdoing or misconduct, the employer must furnish the employee with copies of any public records uncovered by a background check.
