COMPLYING WITH THE 2009 AMENDMENTS TO THE FMLA AND THE ADA

Late last year, the United States Congress passed historic legislation amending the Americans with Disabilities Act. The ADA applies to employers with 20 or more employees. Employers in California also must follow California's law protecting disabled job applicants and employees. This program will educate you about how the changes in the ADA affect your obligations when dealing with disabled applicants and employees.

Meanwhile, if you have over 50 employees, you need to know about sweeping changes that the U.S. Department of Labor made late last year to update the Family and Medical Leave Act. The new rule is a whopping 762 pages long and represents the first significant overhaul of FMLA regulations and implementation since the law?s original enactment over 15 years ago. The new rule becomes effective in mid-January. It makes significant changes in how FMLA policy must be administered and provides detailed guidance on how to implement the new military service member leave benefits enacted earlier in 2008.

Implementing the new FMLA regulations will be especially challenging for California employers because our state family leave law (the California Family Rights Act) obligates employers to follow state law whenever it provides greater rights or benefits to the employee. As a result, California employers must understand how each change in the new FMLA regulations stacks up against existing California law.

This seminar will cover the following topics::

RICHARD S. ROSENBERG, a founding partner of Ballard Rosenberg Golper & Savitt, LLP will be the speaker for this seminar, along with Ms. Katherine Hren (Sr. Associate). Richard is a graduate of the College of Industrial and Labor Relations at Cornell University and the University of Santa Clara Law School. Mr. Rosenberg has spent his entire career (30+ years) providing advice and counsel to management (exclusively) on the entire spectrum of labor relations and employment law matters. He is widely recognized in the legal community for his expertise in employment law and serves as a regular contributing author in the Los Angeles Daily Journal legal newspaper and wrote a regular column on labor law compliance for several years.

Mr. Rosenberg?s work includes advice on employment law strategy and compliance, as well as litigation, covering such diverse areas as wage-hour collective and class actions, traditional labor relations matters (union organizing, strikes/picketing, collective bargaining, grievance handling and arbitration and the acquisition/divesture of unionized businesses), class actions and individual claims for employment discrimination, sexual and other workplace harassment, wrongful termination, whistleblower complaints, occupational safety and health, trade secret protection/enforcement, WARN Act compliance, immigration law compliance, FMLA, ADA, COBRA, HIPAA, and Sarbanes-Oxley whistleblower matters.

He is a recognized expert in wage-hour law and also assists clients develop management oriented employment agreements, personnel policies, trade secret and proprietary information agreements, codes of ethical conduct, non-compete agreements, sexual and other workplace harassment policies, and routine employment forms.

Mr. Rosenberg regularly appears before federal and state courts and administrative agencies such as the NLRB, EEOC and the California DFEH, the Cal/OSHA Appeals Board, United States Department of Labor, the California Division of Labor Standards Enforcement, California Employment Development Department, and the United States Bureau of Citizenship and Immigration Services.

Katherine Hren received her B.A. degree from the University of California, Irvine and her J.D. degree, with distinction, from the University of the Pacific, McGeorge School of Law and is admitted as a member of the Order of the Coif. Ms. Hren is a member of the California Bar Association, the American Bar Association and the Traynor Honor Society and was recently elected to and serving a three-year term on the California State Bar Board of Directors, California Young Lawyers Association.

(Brinker Case)  Though  the case made it considerably easier for employers to comply with the state's meal and rest period regulations, the California Supreme Court has accepted the case for review.  A Supreme Court decision is not expected for a year or more.  With the law in a state of flux, the California Labor Commissioner just announced enforcement guidelines which will apply while we await the Supreme Court's ruling.

Senior Associate Katherine A. Hren conducted a national tele-conference on August 29, 2006 on the subject of lawful hiring. This course offered attendees a ?nuts and bolts? guide to lawful hiring, covering areas of recruiting, interviewing and pre-employment testing. The 90-minute program addressed the realities of hiring today?s workforce, including recent developments on the expansion of those who are considered ?applicants? via internet resume submission and important guidelines to avoid liability under the myriad discrimination laws. Attendees learned how to avoid making unintended employment contracts, asking the right questions to obtain vital information and avoiding improper and illegal pre-employment inquiries. The course also covered different types of pre-employment tests, from drug testing and background checks, to psychological and honesty tests, and the privacy, legal and practical implications associated with each.


PIHRA District 4 - Monthly Meeting: Wage Hour Gotcha's: Small mistakes with big dollar exposure

Partner Richard S. Rosenberg addressed the PIHRA District 4 monthly luncheon on the subject of wage hour law compliance and how little violations can add up to significant financial exposure.
