COMPLYING WITH THE 2009 AMENDMENTS TO THE FMLA AND THE ADA
|
Late last year, the United States Congress passed historic
legislation amending the Americans with Disabilities Act. The ADA
applies to employers with 20 or more employees. Employers in California
also must follow California's law protecting disabled job applicants
and employees. This program will educate you about how the changes in
the ADA affect your obligations when dealing with disabled applicants
and employees.
Meanwhile, if you have over 50 employees, you need to know about
sweeping changes that the U.S. Department of Labor made late last year
to update the Family and Medical Leave Act. The new rule is a whopping
762 pages long and represents the first significant overhaul of FMLA
regulations and implementation since the law?s original enactment over
15 years ago. The new rule becomes effective in mid-January. It makes
significant changes in how FMLA policy must be administered and
provides detailed guidance on how to implement the new military service
member leave benefits enacted earlier in 2008.
Implementing the new FMLA regulations will be especially challenging
for California employers because our state family leave law (the
California Family Rights Act) obligates employers to follow state law
whenever it provides greater rights or benefits to the employee. As a
result, California employers must understand how each change in the new
FMLA regulations stacks up against existing California law.
This seminar will cover the following topics::
- Which rule changes will apply in California
- Which changes must be implemented right away
- New mandatory forms, postings and processes
- The new military service leave rules
RICHARD S. ROSENBERG, a founding partner of Ballard
Rosenberg Golper & Savitt, LLP will be the speaker for this
seminar, along with Ms. Katherine Hren (Sr. Associate). Richard is a
graduate of the College of Industrial and Labor Relations at Cornell
University and the University of Santa Clara Law School. Mr. Rosenberg
has spent his entire career (30+ years) providing advice and counsel to
management (exclusively) on the entire spectrum of labor relations and
employment law matters. He is widely recognized in the legal community
for his expertise in employment law and serves as a regular
contributing author in the Los Angeles Daily Journal legal newspaper
and wrote a regular column on labor law compliance for several years.
Mr. Rosenberg?s work includes advice on employment law strategy and
compliance, as well as litigation, covering such diverse areas as
wage-hour collective and class actions, traditional labor relations
matters (union organizing, strikes/picketing, collective bargaining,
grievance handling and arbitration and the acquisition/divesture of
unionized businesses), class actions and individual claims for
employment discrimination, sexual and other workplace harassment,
wrongful termination, whistleblower complaints, occupational safety and
health, trade secret protection/enforcement, WARN Act compliance,
immigration law compliance, FMLA, ADA, COBRA, HIPAA, and Sarbanes-Oxley
whistleblower matters.
He is a recognized expert in wage-hour law and also assists clients
develop management oriented employment agreements, personnel policies,
trade secret and proprietary information agreements, codes of ethical
conduct, non-compete agreements, sexual and other workplace harassment
policies, and routine employment forms.
Mr. Rosenberg regularly appears before federal and state courts and
administrative agencies such as the NLRB, EEOC and the California DFEH,
the Cal/OSHA Appeals Board, United States Department of Labor, the
California Division of Labor Standards Enforcement, California
Employment Development Department, and the United States Bureau of
Citizenship and Immigration Services.
Katherine Hren received her B.A. degree from the
University of California, Irvine and her J.D. degree, with distinction,
from the University of the Pacific, McGeorge School of Law and is
admitted as a member of the Order of the Coif. Ms. Hren is a member of
the California Bar Association, the American Bar Association and the
Traynor Honor Society and was recently elected to and serving a
three-year term on the California State Bar Board of Directors,
California Young Lawyers Association.

Daily Grill - Studio City
NAVIGATING THE LABOR CODE LABYRINTH
Not only does California have a wealth of statutes governing employers, it also has a wealth of lawyers looking for lucrative class action lawsuits against employers. As an employer, whether of one employee or thousands, you must be vigilant about compliance with the fine details affecting you and your employees.
Linda B. Hurevitz is a trial attorney with the law firm of Ballard Rosenberg Golper & Savitt, LLP. The firm practices exclusively in labor and employment matters on behalf of management. Ms. Hurevitz is a member of the American Board of Trial Advocates having tried over thirty jury trials. She serves as a mediator for both the Los Angeles Superior Court and privately. She has been a frequent speaker and mentor at seminars and continuing education programs relating to harassment, discrimination, and civil rights. Most recently, Ms. Hurevitz successfully defended UCLA in a sexual harassment case involving two professors of psychiatry.
Ms. Hurevitz will discuss some of the areas of the Labor Code which can expose employers to fines, penalties and potential litigation.
• Rest and Meal Breaks
• Applications for Employment - questions regarding criminal convictions

FMLA Webinar
Friday, January 23, 2009
Noon - 1:30 p.m. (Pacific)
COMPLYING WITH THE 2009 AMENDMENTS TO THE FMLA
The U.S. Department of Labor
has issued its long-awaited final rule to update the Family and Medical
Leave Act. The new rule is a whopping 762 pages long and
represents the first significant overhaul of FMLA regulations and
implementation since the law's original enactment over 15 years
ago. The new rule, which becomes effective in mid-January,
makes significant changes in how FMLA policy must be
administered. It also provides detailed guidance on how to
implement the new military service member leave benefits enacted earlier this year.
Implementing the new FMLA regulations will be expecially
challenging for California employers. This is because our state
family leave law (the California Family Rights Act) contains a
provision obligating California employers to follow state law whenever
it provides greater rights or benefits to the employee seeking family
leave. To do that, California employers must understand how each
change in the new FMLA regulations stack up against existing California law.
In our webinar, we will cover the following topics:
- Which FMLA rule changes will apply in California;
- The FMLA changes you need to implement right away;
- New mandatory forms, postings and processes;
- How the new military service leave rules must be implemented; and
- Compliance strategies: steps to take now to be in compliance.

Friday, December 5, 2008
Noon - 1:30 p.m. (Pacific)
MEAL AND REST PERIODS AFTER THE BRINKER CASE:
STRATEGIES FOR LIMITING EXPOSURE TO COSTLY WAGE HOUR CLAIMS
Earlier this year, the California Court of Appeal decided the very favorable Brinker Restaurant case. (Brinker Case) Though the case made it considerably easier for employers to comply with the state's meal and rest period
regulations, the California
Supreme Court has accepted the case for review. A Supreme
Court decision is not expected for a year or more. With
the law in a state of flux, the California Labor Commissioner just
announced enforcement guidelines which will apply while we await
the Supreme Court's ruling.
In our Webinar, we will cover the following topics:
- The current law of meal and rest periods;
- The 5 most common compliance mistakes;
- How Brinker changed the landscape for
employers;
- Policies and practices that the Labor
Commissioner considers compliant;
- Compliance Strategies: What to do while
awaiting the Supreme Court's ruling

| In this dynamic and informative program, Richard S.
Rosenberg and Katherine A. Hren will address the many distractions to
employee productivity which command legal protection under federal and
state time off laws. Do you know when an employer can lawfully refuse a
time off request? Do you know your obligations under federal and state
family leave laws? This program covers the myriad leaves of absence
applicable to California employers with one or more employees.
The program includes a discussion of vacation, sick time, paid time
off, and the maze of California and federal leave rules related to
military leave, disability, pregnancy, baby bonding, ill family members
and registered domestic partners, workers' compensation and mandated
and voluntary benefits during leave. Among the "alphabet soup" of laws
covered are PDL, PFL, FMLA, CFRA, ADA and SDI.
Large and small companies alike are presented with the challenge of
trying to juggle the demands of maintaining profitability and employee
productivity in an increasingly competitive economy.
This Labor Law Update will focus on what you as an employer need to know to remain in compliance:
- The expanding obligations under federal and state family leave laws;
- When may an employer lawfully refuse a time off request;
- The elements of a lawful time off policy;
- The consequences for non compliance;
- New military leave provisions under California and Federal law;
- State and Federal time off provisions that apply to workers injured on and off the job;
- Federal and state laws prohibiting job bias employees and job applicants with a physical or mental disability;
- Interviewing do’s and don’ts;
- Work /life balance laws that require time off for
employees who suffer non- work related injuries, victims of domestic
violence, alcoholics and drug addicts, parents of school age children,
witness and jury duty, civic minded employees, employees undergoing
gender reassignment and volunteer firefighters;
- Religious and ethnic observances;
- Telecommuting, part time work, and other alternative work arrangements;
- Labor Law Update.
You will not want to miss the valuable information provided in the seminar.
