Ballard Rosenberg Golper & Savitt, LLP Secures Favorable Settlement in Wage-Hour Class Action Lawsuit

Partner Jeffrey Fuchsman and associate Rami Yomtov recently concluded a favorable settlement in a consolidated wage and hour class action against one of the Firm’s well-known hotel clients. In early 2014, the hotel was sued in three separate class actions for alleged meal and rest period violations, unpaid minimum wage and overtime, tip-pooling, and failure to provide accurate wage statements. After an unsuccessful early mediation, the Firm persuaded the Superior Court to dismiss the class action for three out of the four named plaintiffs based on a class action waiver provision in an arbitration agreement. While the appeal to the arbitration ruling was pending, we were able to negotiate a much more favorable settlement for the hotel that resolved all three class actions. Final Approval of the class action settlement was granted by the court on August 4, 2016.
