Event Synopsis: The concept of the on-demand workforce or gig economy is not a novel concept, but the ubiquity of smartphones and mobile applications has driven this rapidly evolving trend. Estimates vary, but one survey says that more than 50 million American workers entered the gig economy work force in 2015 and it is likely to boost in the years to come.

On this type of workforce, workers operate as independent contractors wherein they enjoy the freedom of working on their own schedule but are not provided with the same benefits as a traditional employee. In return, companies that use this platform draw savings by reducing employee-related expenses such as payroll taxes and employee benefits.

However, along with the upsurge of the gig economy comes the rise of lawsuits filed against companies by workers alleging violations of federal and state labor laws. The question whether gig workers fall under the classification of employees or independent contractors often arise, but courts litigating related cases have varying opinions that make the gig economy even more confusing.
